The terms governing your access to and use of the PRISM website, publications, and materials.

Welcome to the website of PRISM — Pulmonary Research Institute for Systems & Metrics. These Terms of Use and Participation govern your access to and use of the PRISM website, publications, resources, forms, meeting materials, working group materials, and other content made available through pulmorism.com.
By using this website, submitting content, participating in PRISM activities, or accessing PRISM materials, you agree to these Terms.
About PRISM
PRISM — Pulmonary Research Institute for Systems & Metrics — is an independent voluntary technical forum focused on respiratory device performance measurement, technical discussion, and non-binding guidance.
PRISM is not a registered company, charity, society, regulator, notified body, certification body, accredited laboratory, testing laboratory, trade association, or formal standards-development organization.
PRISM does not provide product certification, regulatory approval, clinical advice, legal advice, reimbursement advice, commercial rankings, product endorsements, or paid testing services.
Non-Binding Technical Guidance
PRISM materials are provided for general educational, technical, and discussion purposes only.
PRISM publications, templates, working group outputs, technical notes, meeting summaries, test-method discussions, and other materials are non-binding. They do not replace applicable laws, regulations, FDA requirements, EU MDR requirements, ISO, IEC, ASTM, clinical judgment, manufacturer responsibilities, independent laboratory review, or professional advice.
Users are responsible for independently evaluating whether PRISM materials are appropriate for their own technical, clinical, regulatory, laboratory, product-development, or business purposes.
No Medical, Clinical, Regulatory, Legal, or Reimbursement Advice
The PRISM website does not provide medical, clinical, regulatory, legal, tax, reimbursement, coding, coverage, payment, or compliance advice.
Nothing on this website should be interpreted as a recommendation for patient care, clinical decision-making, product labeling, regulatory submission strategy, reimbursement strategy, or payer coverage position.
Manufacturers, laboratories, clinicians, researchers, and other users remain responsible for their own decisions, claims, submissions, testing programs, safety assessments, labeling, and compliance obligations.
No Certification, Approval, Validation, Accreditation, or Endorsement
Use of PRISM materials does not mean that any device, method, manufacturer, laboratory, test setup, publication, data set, contributor, or test result has been certified, approved, validated, accredited, cleared, accepted, or endorsed by PRISM.
PRISM materials may not be used to imply:
- regulatory clearance or approval;
- clinical safety or effectiveness;
- product superiority;
- product endorsement;
- certification or accreditation;
- compliance with any law, regulation, or standard;
- acceptance by any regulator, notified body, payer, standards body, laboratory, hospital, clinician, or third party.
Website Content and Publications
PRISM may publish technical papers, white papers, discussion papers, consensus notes, test-method discussions, educational materials, data-reporting templates, meeting summaries, and other resources.
PRISM may update, revise, remove, or archive website content at any time. PRISM does not guarantee that any content is complete, current, accurate, or suitable for a particular purpose.
Where appropriate, PRISM publications may include author names, affiliations, reviewer acknowledgements, conflict-of-interest disclosures, sponsor disclosures, methodology, limitations, version numbers, and publication dates.
User Submissions and Contributor Materials
Users may have the opportunity to submit comments, technical feedback, manuscripts, test methods, working group materials, data summaries, biographies, disclosures, or other content to PRISM.
By submitting content to PRISM, you represent that:
- you have the right to submit the content;
- the content does not violate third-party rights;
- the content does not contain confidential information unless PRISM has agreed in writing to receive it;
- the content does not contain patient-identifiable information or protected health information;
- the content is accurate to the best of your knowledge;
- you have disclosed relevant conflicts of interest.
PRISM may review, edit, decline, remove, summarize, publish, or archive submitted content at its discretion.
Confidentiality and Prohibited Submissions
Unless PRISM has entered into a separate written confidentiality agreement, submissions to PRISM are considered non-confidential.
Do not submit:
- proprietary device data;
- trade secrets;
- confidential business information;
- unpublished regulatory information;
- confidential supplier information;
- patient-identifiable information;
- protected health information;
- personal health information;
- third-party confidential information;
- information you are not authorized to share.
If confidential test data or proprietary information is used for PRISM discussion, it should be anonymized or aggregated where possible and handled only under an appropriate written agreement.
Intellectual Property
Users and contributors retain ownership of their pre-existing intellectual property, data, methods, device information, software, know-how, and other proprietary materials.
By submitting content to PRISM for review, discussion, publication, or website use, you grant PRISM a non-exclusive, royalty-free, worldwide license to review, reproduce, edit, publish, display, distribute, archive, and use the submitted content for PRISM’s non-commercial educational and technical purposes.
Unless otherwise stated, PRISM publications may be shared for non-commercial educational and technical purposes with proper attribution. PRISM materials may not be modified in a way that is misleading or inconsistent with the original publication.
Use of PRISM Name, Logo, Domain, and Materials
The PRISM name, logo, domain, website content, publication excerpts, meeting materials, working group outputs, and public communications may only be used in a manner consistent with PRISM’s purpose and approved procedures.
You may not use the PRISM name, logo, domain, or publication excerpts in advertising, promotional materials, sales presentations, product comparisons, regulatory submissions, reimbursement materials, investor materials, press releases, social media posts, or other public communications without prior written approval from the PRISM Steering Board.
You may not imply that PRISM endorses, certifies, approves, validates, ranks, or recommends any product, company, laboratory, test method, clinical approach, regulatory strategy, or commercial claim.
Conflicts of Interest and Sponsor Disclosures
PRISM participants, authors, reviewers, working group members, advisors, and contributors are responsible for disclosing relevant financial, employment, consulting, research, product-related, sponsor-related, or other interests that could reasonably be perceived as influencing their participation or contribution.
PRISM may publish conflict-of-interest disclosures, sponsor disclosures, contributor affiliations, reviewer acknowledgements, or other transparency statements with relevant materials.
Sponsor support, if any, does not provide editorial control over PRISM conclusions.
Competition-Law and Commercial Conduct Rules
PRISM activities may include participants from manufacturers, laboratories, academic groups, clinical organizations, and other industry stakeholders. Participants may not use PRISM meetings, working groups, submissions, website tools, or communications to discuss, exchange, coordinate, or influence commercially sensitive information.
Prohibited topics include, but are not limited to:
- product pricing, discounts, margins, or commercial terms;
- reimbursement strategy, payer strategy, or coverage strategy;
- customer allocation or market allocation;
- sales strategy, sales forecasts, or sales targets;
- production capacity, supply constraints, or confidential supplier strategy;
- supplier boycotts or coordinated purchasing activity;
- confidential regulatory strategies;
- confidential commercial plans;
- any coordinated action that may restrict competition.
PRISM may stop, remove, or decline any discussion or submission that appears commercially sensitive, inappropriate, or inconsistent with PRISM’s purpose.
Testing-Related Content and Limitations
PRISM may discuss, facilitate, review, or publish technical materials related to respiratory device performance measurement, bench testing, test setups, waveform analysis, pressure, flow, volume, oscillation, bias-flow, calibration, uncertainty, data analysis, and reporting methods.
Any testing-related content should identify, where applicable, the test objective, equipment, calibration approach, test conditions, data-processing method, limitations, responsible laboratory or volunteer, sponsor disclosure, and publication rights.
PRISM does not represent that any test result certifies safety, effectiveness, regulatory compliance, regulatory acceptability, clinical performance, or product superiority.
Device manufacturers remain responsible for product claims, regulatory submissions, safety assessments, labeling, and compliance obligations.
Privacy and Personal Information
PRISM is not intended to collect patient information, personal health information, protected health information, or identifiable clinical data.
Users should not submit patient-identifiable information through the website, forms, emails, comments, uploads, or other PRISM communication channels.
PRISM may collect limited personal information, such as names, email addresses, affiliations, biographies, disclosure information, or inquiry details, when users voluntarily provide it. PRISM should use and retain this information only as reasonably necessary for forum administration, communications, publication review, disclosure records, and website operations.
A separate Privacy Policy should describe what information PRISM collects, how it is used, how long it is retained, and how it is protected. The FTC recommends that organizations understand what personal information they collect, keep only what they need, protect it, and dispose of it securely when no longer needed.
Website Accessibility
PRISM aims to make its website and public materials reasonably accessible. Users who experience difficulty accessing content may contact PRISM using the contact information provided on the website.

PRISM does not warrant that any website content, publication, test method, template, meeting summary, technical guidance, data interpretation, or other material is complete, accurate, current, reliable, suitable for a particular purpose, accepted by any regulator, or appropriate for any specific product, laboratory, clinical, commercial, or regulatory use.
Limitation of Liability
To the fullest extent permitted by applicable law, PRISM, its Steering Board, members, contributors, reviewers, volunteers, sponsors, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the website, reliance on PRISM materials, participation in PRISM activities, submission of content, or inability to access the website.
Users are responsible for independently verifying information before relying on it.
Removal of Content and Participation Restrictions
PRISM may remove content, decline submissions, restrict access, or limit participation if PRISM determines that the activity or content is inconsistent with these Terms, PRISM’s constitution, PRISM’s non-commercial purpose, confidentiality expectations, intellectual property rights, conflict-of-interest requirements, competition-law safeguards, or applicable law.
Changes to These Terms
PRISM may update these Terms from time to time. Updated Terms will be posted on pulmorism.com with a revised effective date.
Continued use of the website after updated Terms are posted means you accept the revised Terms.
